These Terms of Service (“Terms”) govern your access to and use of the Form and Comfort website, online store, products, content, and related services (collectively, the “Services”).

Throughout these Terms, “Form and Comfort,” “we,” “us,” and “our” refer to Form and Comfort.

By visiting our website, placing an order, creating an account, submitting a review, or otherwise using the Services, you agree to these Terms and the policies incorporated into them, including our Privacy Policy, Shipping Policy, and Return and Refund Policy.

If you do not agree to these Terms, do not use the Services.

Eligibility

You must be at least the age of majority in your state of residence to place an order, or you must use the Services with the permission and supervision of a parent or legal guardian.

By placing an order, you represent that the information you provide is accurate and that you are authorized to use the selected payment method.

Our Product

Form and Comfort sells supportive consumer apparel designed for everyday wear and workouts, including gym sessions, cardio, and running.

The Everyday Bra is not medical equipment and is not intended to diagnose, treat, cure, or prevent any medical condition or injury. Information provided through the Services is for general informational purposes and is not medical advice.

Support, comfort, fit, sweat management, and movement control can vary by person, activity, body shape, and selected size. We do not guarantee that the product will eliminate all movement, sweat, discomfort, or risk of injury.

Follow the published size guidance and inspect the product before use. Stop wearing the product if it causes unusual pain, numbness, restricted breathing, significant skin irritation, or another adverse reaction. Consult a qualified healthcare professional if you have a medical condition or concern that may affect your use of the product.

Product Information

We make reasonable efforts to display product descriptions, colors, images, materials, pricing, and availability accurately.

However:

  • Colors may appear differently depending on your device or display settings.

  • Minor variations may occur between production batches.

  • Product images may include lighting, styling, or model differences.

  • Fit and appearance may vary between customers.

  • Packaging may change without notice.

These reasonable variations are not necessarily product defects.

We may update product information, correct errors, or change products at any time. Nothing in this section limits your rights under our Return and Refund Policy or applicable law.

Prices and Payment

All prices are displayed in U.S. dollars unless stated otherwise.

Prices, promotions, and discounts may change at any time before you place an order. The price you pay is the price displayed and accepted at checkout, subject to correction of obvious errors.

Payment must be completed using one of the payment methods offered at checkout. Payments are processed by Shopify and applicable payment providers.

If a product is listed at an obviously incorrect price because of a technical, typographical, or system error, we may cancel the affected order and issue a full refund.

Bundle Pricing and Discounts

We may offer quantity-based pricing when multiple qualifying bras are purchased together.

Bundle discounts:

  • Apply only to qualifying products and quantities shown in the offer.

  • Must be purchased together in the same qualifying order.

  • Cannot be combined with another discount unless expressly stated.

  • May be changed or withdrawn for future orders at any time.

  • Do not have cash value.

If part of a discounted bundle is refunded or returned, the refund is based on the actual discounted amount allocated to and paid for the returned item—not the regular single-item price.

Any savings amount displayed represents the difference between the applicable regular single-item pricing and the advertised bundle price at the time of purchase.

Orders

Submitting an order is an offer to purchase the products in your cart. An order is not finally accepted until payment is authorized and we accept the order for fulfillment.

We may decline, limit, or cancel an order when reasonably necessary, including if:

  • A product or variant is unavailable.

  • Payment cannot be authorized.

  • We suspect fraud, unauthorized activity, or resale.

  • The shipping address is incomplete, invalid, or outside our service area.

  • A pricing, inventory, discount, or product-description error occurred.

  • The order violates these Terms or another published policy.

  • We are legally prohibited from completing the order.

If we cancel a paid order, we will refund the applicable amount to the original payment method.

We reserve the right to limit quantities purchased by a person, household, address, payment method, or customer account.

Shipping and Delivery

We currently ship only within the United States.

Standard shipping is free on all orders unless a different shipping charge is clearly displayed and accepted at checkout.

Orders are generally processed within 24–48 hours. After processing, estimated shipping time is 3–5 business days.

These are estimates rather than guarantees. Delivery may be affected by carrier delays, weather, holidays, incorrect addresses, access restrictions, or circumstances outside our reasonable control.

Tracking information will be sent to the email address provided with the order when it becomes available.

If we cannot ship within the promised timeframe, we will provide notice and any delay, cancellation, or refund options required by applicable law.

Additional shipping terms are provided in our Shipping Policy, which forms part of these Terms.

Address Changes and Cancellations

Requests to cancel an order or change its shipping address must be emailed to support@formandcomfort.com within 24 hours of ordering.

We will make reasonable efforts to accommodate the request, but cancellation or modification is not guaranteed once an order has entered processing or fulfillment.

Customers are responsible for providing a complete and accurate shipping address. If an address error is not reported within the 24-hour window, we may be unable to redirect or replace the shipment.

Lost or Missing Packages

If tracking stops updating, a package appears to be lost, or tracking shows “delivered” but you cannot locate the package, contact support@formandcomfort.com with your order number.

We will review the shipment and work with the carrier as appropriate. Resolutions are determined based on the tracking information, carrier investigation, order details, and applicable law.

90-Day Wear-It Guarantee

Our Return and Refund Policy forms part of these Terms.

The 90-Day Wear-It Guarantee begins on the order date.

Under the guarantee:

  • The first bra in an order may be worn and washed while the customer evaluates its fit and comfort.

  • If the first bra is not right, the customer may request an eligible size replacement or refund without returning that first worn bra.

  • Any refund is based on the actual discounted amount paid for that bra.

  • Additional bras, including additional items purchased through a bundle, must be unworn, unused, have their original tags, and remain in their original packaging to qualify for a return or exchange.

  • Customers are responsible for securely packaging eligible returns and paying return-shipping costs.

  • Items requiring return must not be sent without first contacting us and receiving return instructions.

Approved refunds are submitted to the original payment method within 48–72 hours after approval. Financial institutions may require additional time to post the refund.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer-protection law.

Customer Accounts

If customer accounts are available, you are responsible for:

  • Providing accurate information.

  • Maintaining the confidentiality of your login credentials.

  • Restricting access to your account and devices.

  • Notifying us promptly if you suspect unauthorized access.

We may suspend or terminate an account reasonably believed to be involved in fraud, abuse, unlawful conduct, or a violation of these Terms.

Reviews and User Content

You may be able to submit reviews, ratings, photographs, videos, comments, or other content through the Services.

You agree that submitted content:

  • Is truthful and reflects your genuine experience.

  • Does not impersonate another person.

  • Does not violate another party’s copyright, trademark, privacy, publicity, or other rights.

  • Is not fraudulent, unlawful, threatening, abusive, discriminatory, obscene, or misleading.

  • Does not contain malicious software, advertising spam, or confidential personal information.

By submitting content, you grant Form and Comfort a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, distribute, and use that content in connection with our website, social media, advertising, and other marketing, subject to applicable law.

You retain ownership of your original content. You represent that you have the rights necessary to submit it and grant this license.

We may moderate or remove content that violates these Terms, but we are not obligated to publish every submission. We will not alter a review in a way that misrepresents the reviewer’s opinion.

Contact support@formandcomfort.com if you want to request removal of content you submitted.

Acceptable Use

You may not use the Services to:

  • Violate any law or regulation.

  • Infringe another person’s rights.

  • Submit false, fraudulent, or misleading information.

  • Transmit malware or harmful code.

  • Attempt to gain unauthorized access to the Services or another account.

  • Scrape, copy, or extract store content for commercial use without permission.

  • Interfere with the security or operation of the Services.

  • Place fraudulent orders or abuse promotions, refunds, reviews, or payment disputes.

  • Use automated systems to overload or disrupt the Services.

  • Resell products where we have expressly prohibited resale.

We may restrict or terminate access for violations of these Terms.

Intellectual Property

The Services and their content—including brand names, logos, product names, text, graphics, photographs, videos, layouts, designs, and software—are owned by or licensed to Form and Comfort and are protected by applicable intellectual-property laws.

You may use the Services only for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, sell, license, publish, or commercially exploit our content without prior written permission.

Nothing in these Terms grants you ownership of any Form and Comfort intellectual property.

Third-Party Services and Links

Shopify provides the ecommerce platform used to operate our store. We may also use third-party providers for payments, reviews, communications, analytics, advertising, fulfillment, shipping, and other business services.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for the content, availability, security, or practices of websites and services we do not control.

The inclusion of a third-party link does not necessarily mean that Form and Comfort endorses that third party.

Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By using the Services, you acknowledge that personal information may be processed by Shopify and other service providers as described in that policy.

Service Availability

We do not guarantee that the website or Services will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, or discontinue any portion of the Services when reasonably necessary. We may also correct errors or update information without prior notice, subject to our obligations for orders already accepted.

Disclaimer of Warranties

Except for our express 90-Day Wear-It Guarantee, any written product warranty, and warranties that cannot legally be excluded, the Services and products are provided on an “as available” basis.

To the fullest extent permitted by law, we disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

Some states do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, Form and Comfort and its owners, employees, contractors, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from your use of the Services or products.

To the fullest extent permitted by law, our total liability for a claim relating to a product or order will not exceed the amount you actually paid for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including any non-waivable consumer rights.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Form and Comfort harmless from third-party claims, losses, or reasonable expenses arising from:

  • Your unlawful misuse of the Services.

  • Content you submit in violation of another person’s rights.

  • Your material violation of these Terms.

This section does not require you to indemnify Form and Comfort for our own unlawful conduct, negligence, or misconduct.

Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts and applicable federal law, without regard to conflict-of-law principles.

Subject to any rights you cannot waive under the laws of your state, disputes relating to these Terms or the Services will be brought before a court with appropriate jurisdiction in Massachusetts.

Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remaining Terms will remain in effect.

No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

Entire Agreement

These Terms, together with the policies and notices incorporated into them, constitute the entire agreement between you and Form and Comfort regarding the Services.

Any ambiguity will not automatically be interpreted against the party that drafted these Terms.

Changes to These Terms

We may update these Terms to reflect changes to the Services, our business practices, or applicable law.

The revised Terms will be posted on this website with an updated date. Changes apply prospectively from their effective date. The terms applicable to a completed purchase are generally those presented when the order was placed, except where a change is required by law.
